Waiting for your Car Accident Settlement Check
If you have ever been in a car accident, you know the anguish that can follow. Whether you have a serious injury or simply not having your vehicle when you need it most, the anxiety is great. At the Hall-Justice Law Firm, we recognize your angst and will do everything in our power to move things along and get you the car accident settlement check you deserve in a timely fashion.
Step one is to sign a release.
After a settlement has been reached you will sign a release. This is a document essentially saying you (the plaintiff) are releasing the defendant from any future lawsuits or claims against them.
What is the average time frame?
After a case is finally settled, attorneys will receive a check with the decided upon amount from the insurance company or defendant. This usually takes around 2 to 4 weeks after the final decision. The check is then deposited into an account to make sure the check clears. (Usually, it does clear, but sometimes it does not. We want to be on the safe side to avoid extra delays). There are other factors that may delay you receiving your check, such as if government offices are involved, (like Medicare) and they may need a 60 day waiting period to investigate the claim. Overall, the bottom line is that it could take up to 90 or so for everything to be finalized and car accident settlement check written.
Why are there deductions from my check?
The car accident settlement is decided by all parties involved and the money is paid out according to agreement made. Portions would go to:
- Client (that’s you)
- Attorney Fees
- Expenses
- Medicare or Health Insurance
There should not be any surprises, as the amounts will be set forth in the settlement.
