You’re sitting at a red light when someone slams into the back of your car. The impact is hard. Your neck snaps forward. You’re shaken, maybe hurt and definitely rattled.
Then you find out the other driver has no insurance.
It’s more common than you’d think. More than one in seven drivers—15.4% of motorists—were uninsured in 2023, according to the Insurance Research Council. And when one of them causes an accident that injures you or damages your property, figuring out how to recover compensation becomes significantly more complicated.

Why So Many Drivers Go Without Insurance
Auto liability insurance is mandatory in 49 states and the District of Columbia, but not everyone follows the rules. Some people let their policies lapse because they can’t afford the premiums. Others drive without ever purchasing coverage in the first place.

If you have uninsured motorist (UM) coverage, this is exactly what it’s designed for. UM coverage kicks in when the at-fault driver has no insurance or when they flee the scene and can’t be identified.
Here’s the thing: you’re filing a claim with your own insurance company, but they’re not exactly thrilled about paying it. They’ll investigate the accident, scrutinize your claim, and look for reasons to reduce what they owe.
Twenty-two jurisdictions require uninsured motorist coverage, but in states where it’s optional, many drivers skip it to save on premiums. If you don’t have UM coverage, you’ll have to explore other options.
Use Your Collision Coverage
If you have collision coverage, it can pay for vehicle repairs regardless of who caused the accident. You’ll need to pay your deductible first, but you won’t have to wait for the at-fault driver to somehow come up with the money.
Your insurance company might then try to recover what they paid through subrogation—essentially going after the uninsured driver to get reimbursed. If they succeed, you might get your deductible back. But if the other driver has no assets, that recovery isn’t likely.
Sue The At-Fault Driver Directly
You can file a lawsuit against the uninsured driver personally. If you win, the court can order them to pay damages for your medical bills, lost wages, vehicle repairs, and pain and suffering.
But here’s the reality: most people driving without insurance don’t have significant assets. Winning a judgment is one thing. Actually, collecting the money is another.
The court can garnish wages or place liens on property, but if the person is unemployed, doesn’t own a home, and has no savings, there’s not much to collect. You might end up with a judgment that’s essentially worthless.
What If You Don’t Have Uninsured Motorist Coverage?
If you don’t have UM or collision coverage, your options narrow considerably. You can still sue the at-fault driver, but for all the reasons mentioned above, that’s often an uphill battle with limited prospects for actual recovery.
The truth is, not having UM coverage puts you in a tough spot when an uninsured driver causes a crash. It’s worth checking your policy now to see what protection you actually have.
Hit-and-Run Accidents And Underinsured Drivers
A hit-and-run is essentially the same as being hit by an uninsured driver—you don’t have anyone’s insurance to file a claim against. If you have uninsured motorist coverage, it should apply here too.
Some policies also include underinsured motorist coverage, which helps when the at-fault driver has insurance but not enough to cover your damages. Fourteen states require underinsured motorist coverage. If the at-fault driver carries only the state minimum and your injuries far exceed that amount, underinsured coverage can make up the difference.
Protecting Yourself Before An Accident Happens
The best time to think about uninsured motorist coverage is before you need it. When you’re reviewing your auto insurance policy, pay attention to your UM limits. Are they high enough to actually protect you if a serious accident occurs?
Consider this scenario: You’re rear-ended by an uninsured driver at highway speed. You suffer a herniated disc requiring surgery, miss weeks of work, and face substantial medical bills. If your UM coverage has low limits, you could be absorbing a significant portion of that loss yourself.
Higher UM limits usually don’t cost dramatically more in premiums, but they can make an enormous difference when you actually need them.
